1. Mental Health Disclaimer
   • By agreeing to the terms, you acknowledge that you understand that the FieldResponder app is not a Substitute for Professional Care: FieldResponder is a wellness awareness tool and is not intended to diagnose, treat, cure, or prevent any mental health condition. The app does not provide medical advice.
   • Emergency Services: If you are experiencing a mental health emergency, contact emergency services (911 in the US) or a crisis hotline immediately. The app is not monitored 24/7 and should not be used for emergency communications.
   • Seek Professional Help: We encourage users experiencing mental health concerns to consult with qualified healthcare providers.
2. Acceptance of TermsBy accessing or using FieldResponder ("the App"), you agree to be bound by these Terms of Use. The App is owned and operated by The Evergreen Collective, LLC ("we," "us," or "our"). If you do not agree to these terms, do not use the App.
3. Description of ServiceFieldResponder is a stress injury awareness platform designed to help teams monitor and mitigate stress injuries. The App provides tools for self-assessment, anonymous data sharing, and team insights.
4. User Accounts and RegistrationYou must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
5. Privacy and Data Sharing
   • Default Anonymous Sharing: By default, all data you submit through the App is shared anonymously with your team. No personally identifiable information (PII) is attached to your responses unless you explicitly opt-in.
   • Opt-In for Identified Data: You may choose to share your data with your PII attached. This is entirely voluntary.
   • No Data Sales: We do not sell, rent, or trade your personal information to third parties for marketing purposes.

6. Permitted UseYou agree to use the App only for lawful purposes and in accordance with these Terms. You may not:
   • Use the App in any way that violates applicable laws or regulations
   • Attempt to gain unauthorized access to any portion of the App
   • Interfere with or disrupt the App's functionality
   • Use the App to harass, abuse, or harm others
   • Impersonate any person or entity
7. Intellectual PropertyAll content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by The Evergreen Collective, LLC and Responder Alliance, LLC, and protected by copyright, trademark, and other intellectual property laws.
8. User ContentYou retain ownership of any content you submit through the App. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely to provide and improve the App's services.
9. Limitation of LiabilityTo the maximum extent permitted by law, The Evergreen Collective, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
10. IndemnificationYou agree to indemnify and hold harmless The Evergreen Collective, LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
11. Modifications to TermsWe reserve the right to modify these Terms at any time. We will notify users of significant changes via email or through the App. Continued use of the App after changes constitutes acceptance of the modified Terms.
12. TerminationWe may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by emailing a request to info@fieldresponder.com. Upon termination, you may request deletion of your data as outlined in our Privacy Policy.
13. Governing LawThese Terms are governed by the laws of the State of Colorado, without regard to conflict of law provisions.
14. Dispute ResolutionAny disputes arising from these Terms or use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
15. SeverabilityIf any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
